Andrew Kates focuses his practice on product liability litigation, labor and employment law, and complex civil litigation. Mr. Kates handles matters from inception to completion – including trial and appellate work – representing clients in state and federal courts throughout New York. Mr. Kates conducts party and non-party depositions; defends corporate representatives at depositions; drafts discovery, motions and trial briefs; prepares expert witnesses; and conducts mediation and arbitration. Mr. Kates has also argued numerous motions and second-chaired multiple asbestos trials.
Mr. Kates has significant experience serving as local counsel for various clients in the New York City Asbestos Litigation ("NYCAL"). Notably, Mr. Kates recently succeeded in overturning a decision of the NYCAL Administrative Judge on the issue of attorney-client privilege.
With respect to labor and employment, Mr. Kates represents employers in all facets of employer-related litigation. Additionally, Mr. Kates counsels employers in drafting handbooks, implementing employment policies and regulatory compliance.
Mr. Kates also manages complex data preservation issues and high-volume electronically stored information ("ESI") productions. Mr. Kates assists corporations in ESI management and storage, ensuring efficient compliance with electronic discovery and employee privacy obligations.
Mr. Kates earned his Juris Doctor cum laude from Touro Law Center, where he received Dean’s List honors and was awarded the CALI Excellence for the Future Award on three occasions. He holds a Bachelor’s Degree from Hofstra University.
