Andrew Kates focuses his practice on labor and employment law, complex civil litigation, and product liability litigation. Mr. Kates handles matters from inception to completion – including trial and appellate work – representing clients in state and federal courts throughout New York.
Attendant to his labor and employment practice, Mr. Kates represents and counsels employers in all facets of employer-related litigation. Specifically, Mr. Kates handles matters arising under the Age Discrimination in Employment Act (“ADEA”); Americans with Disabilities Act (“ADA”); Employee Retirement Income Security Act (“ERISA”); Fair Labor Standards Act (“FLSA”); Title VII (harassment/discrimination claims); New York State Human Rights Law (“NYSHRL”); New York Labor Law (“NYLL”); employment contracts, including non-compete agreements; whistleblower and retaliation claims; and other employment-related matters. Additionally, Mr. Kates counsels employers in drafting handbooks, implementing employment policies, and compliance with federal, state, and local laws.
Mr. Kates has extensive civil litigation experience representing and counseling corporations and individuals in all phases of litigation. Mr. Kates handles matters sounding in general liability, real property, breach of contract, environmental law, toxic tort, construction, insurance coverage, class actions, and other areas of law.
Mr. Kates also manages complex data preservation issues and high-volume electronically stored information (“ESI”) productions. Mr. Kates assists corporations in the management and storage of ESI, enabling them to efficiently comply with electronic discovery and employee privacy obligations, among other pitfalls facing corporations in today’s electronically-driven market.
Mr. Kates earned his Juris Doctor degree cum laude from Touro College Jacob D. Fuchsberg Law Center, where he received Dean’s List honors and received the honor of the CALI Excellence for the Future Award on three occasions. He also holds a bachelor’s degree in business administration from Hofstra University’s Frank G. Zarb School of Business.
