Segal McCambridge Attorney Mitchell Morinec Wins Dismissal in Commercial Construction Case

September 26, 2011

Segal McCambridge attorney Mitchell Morinec recently argued and prevailed on a motion to dismiss in a commercial construction matter in the Circuit Court of Cook County in which the plaintiff claimed more than $12.5 million in total damages and $4.5 million in damages against Segal McCambridge's client, a Fortune 500 company, alone. Mr. Morinec successfully argued that the plaintiff's failure to comply with specific provisions in the warranty of the client rendered the warranty void, leaving the plaintiff without a viable cause of action under Illinois law. On September 20, 2011, the court dismissed the case with prejudice.
