After a week-long trial in a dispute over the timely completion of condominium units, Cook County Circuit Court Judge Dennis Burke ruled today in favor of five buyers and against Grant Park 2, LLC, ruling that Grant Park 2, LLC breached its purchase agreements with the buyers. For a few of the condos, Grant Park 2, LLC was more than a year late completing the units.
Grant Park 2, LLC argued that its contractual obligation to complete the condominium units in the time specified was excused due to a multitude of delays, including delays acquiring a permit for the foundation, water infiltration during construction of the foundation, material shortages, weather such as rain, snow, cold temperatures and lightning, an operators' and laborers' strike, a financing delay, and unspecified delays caused by other delays.
Notably, 30 or more lawsuits arising out of the One Museum Park West building involving the same failure to timely complete issue currently are pending against Grant Park 2, LLC in the Circuit Court of Cook County.
