Segal McCambridge Shareholder Robert E. O'Malley Wins "Not Guilty" Finding on Behalf of Hospital Client

Segal McCambridge shareholder Robert E. O'Malley obtained a finding of "not guilty" on behalf of a hospital client in Cook County, Illinois, on October 13, 2010. The plaintiff's decedent, a 41-year-old bank executive, allegedly died from an acute heart attack following hip replacement surgery. Upon completion of the plaintiff's case against the hospital, Mr. O'Malley's client was dismissed immediately and the case continued to verdict as to the remaining defendants. Plaintiff's allegations against the hospital were based upon the mistaken appearance that one of the defendant physicians was acting as an agent of the hospital. Plaintiff's settlement demand to the hospital was $450,000; there was no offer made.
