Segal McCambridge Partner Obtains Dismissal In Asbestos Exposure Case

On February 29, 2008, Segal McCambridge partner, David Weinberg, obtained a dismissal of a third-party complaint seeking contribution and indemnification in Middlesex County, New Jersey, on behalf of a heating supply company.  Mr. Weinberg successfully briefed and argued that the defendant/third-party plaintiff had not properly perfected its rights to seek contribution or indemnification.  The motion was argued in the Superior Court of New Jersey for Middlesex County.  The underlying case resulted in a $10 million jury verdict in favor of a former oil service technician who developed mesothelioma as a result of exposure to asbestos.  Following the verdict, the sole remaining defendant brought a third-party action against the heating supply company.  The settlement demand was $2.75 million at the time of the dismissal.
