SMSM Attorneys Successful at Obtaining Clarification in Indiana Premises Liability Standards

Segal McCambridge Singer & Mahoney attorneys, Jason L. Kennedy and Keith J. Hays, of the Chicago office, were successful as amicus curiae in a recent decision from the Indiana Supreme Court in obtaining a clarification in Indiana premises liability standards to the employees of third-party contractors in asbestos cases. In the PSI v. Roberts Jr., 829 N.E.2d 943 (Ind. 2005), decision, the Indiana Supreme Court held that a premises owner should not be held liable for the injuries to an employee of an independent contractor, such as Plaintiff. Jason Kennedy submitted an amicus curiae brief on behalf of O'Malia Food Markets and Keith Hays filed an amicus curiae brief on behalf of the Indiana Manufacturers Association.
