SMSM Partner Obtains Dismissal on All Counts in Warranty Case

Segal McCambridge Singer & Mahoney partner, Paul Wojcicki, recently obtained a dismissal on all counts for a motor home manufacturer in a matter where plaintiff sued manufacturer when motor home needed numerous repairs in first few months of ownership. Plaintiff moved to remand based on inadequate amount in controversey. On manufacturer's motion to dismiss, the court, relying on several prior decisions in cases handled by Mr. Wojcicki, dismissed with prejudice, claims brought under the Magnuson-Moss Act, UCC, and Illinois common law.
