Alan Taylor Obtains Summary Disposition for Sha Realty Corporation in Property Ownership Dispute
Detroit - On June 6, 2013, immediately prior to jury selection in the 36th District Court, shareholder Alan J. Taylor successfully obtained Summary Disposition in a property ownership dispute between client Sha Realty Corporation and the property’s prior owner. Mr. Taylor orally reiterated a previously denied Motion for Summary Disposition, arguing that no genuine issue of material fact existed and that the property’s previous owner was now a post-foreclosure trespasser who was refusing to vacate the property.
In Sha Realty v. J. Thomas, the prior owner had claimed a defective foreclosure occurred and that he still held equitable ownership of the property, a mixed-use commercial and residential parcel. Although counsel and witnesses were ready to proceed to trial, Mr. Taylor successfully convinced the Court that a trial was unnecessary. Following Mr. Taylor’s oral argument, the Court concluded the case by issuing a Possession Judgment in favor of Sha Realty Corporation holding, as a matter of law, that Sha owned the Property.
