Kerry Lynn Rhoads Successfully Defends Insurance Company in Coverage Dispute in Eastern District of Michigan

Kerry Lynn Rhoads secured a defense victory for an insurance client in the Eastern District of Michigan on a case involving a dispute over homeowner’s coverage.

The matter involved a plaintiff who sought in excess of $200,000 in homeowner’s coverage after an alleged fire loss in the City of Detroit. 

Following an investigation led by Kerry Lynn Rhoads including examination under oath testimony, the claim was denied. The plaintiff then filed suit in federal court, and she filed a Motion for Summary Judgment on behalf of the insurer citing policy defenses including fraud, misrepresentation, the lack of insurable interest in the subject property and other statutory defenses. The plaintiff’s counsel then voluntarily dismissed the complaint with prejudice.
