Arbitration clauses can bind non-parties

It is common knowledge these days that the provisions of a construction contract govern the rights and responsibilities of the various project participants and those entities that sign the construction contract are bound by its terms until project completion. What may not be common knowledge is that certain contract provisions, such as arbitration clauses, may bind other contractors or sureties even though they were not parties to and never signed the contract.
