Maryland’s Court of Appeals recently recognized that medical monitoring is an available remedy in cases alleging exposure to hazardous substances due to the negligence of the defendant. The decision, Exxon Mobil Corp. v. Albright, 433 Md. 303 (2013), exposes our clients to a new category of compensatory damages as well as additional litigation concerning the long-term health effects of exposure to allegedly hazardous substances.
