This November 2012 issue of “Trial Briefs,” the monthly newsletter from the Illinois State Bar Association’s Section on Civil Practice and Procedure, features an article by Shareholder John Kohnke. The article, “Confidential Settlements vs. Non-Settling Defendants’ Right to Know,” looks into Illinois courts’ current refusal to force disclosure of settlements and set-off amounts before pre-trial and trial. In response, defendants should be allowed to introduce evidence and jury verdict forms containing the name of settling defendants absent from a good faith settlement order.
