In an unexpected opinion issued September 23, 2014 in the case of Geyman v. Amchem Products, Inc. et al (Cause No. 49D02-9801-MI-0001-360), Indiana Superior Court Judge Theodore Sosin denied Defendant General Electric Company’s motion for summary judgment based upon the Indiana Product Liability Statute of Repose, declining to apply Indiana Supreme Court precedent that has been in place for over a decade.  In reinterpreting the legislative intent and constitutionality of the Indiana Product Liability Statute of Repose as it applies to claims for asbestos-related injuries, Judge Sosin’s opinion has the potential to dramatically change the landscape of asbestos litigation for product manufacturers in Indiana.
