The stakes in the litigation are high.  72 corporations have filed for bankruptcy protection based on liability exposure and litigation experience. Cases involving mesothelioma and lung cancer have a history of enormous jury verdicts, and numerous asbestos defendants have been assessed punitive damages. Billions of dollars in indemnity have been paid by insurers and manufacturers, and the claims rate continues to explode.  Plaintiffs have expanded the theories of liability to include premises owners, small distributors, installers and contractors. Manufacturers of encapsulated asbestos products that were previously peripheral parties have now become target defendants. Every defendant must be trial ready in this environment. Corporate defendants must be represented by counsel with comprehensive knowledge of government regulations, and the ability to present the state of the art and medical causation defenses.
